Man appears in a Kabarnet court for allegedly defiling a 12-year-old girl

A man has been arraigned at a Kabarnet court for allegedly defiling a 12 –year- old girl at Kampi Samaki in Baringo South Sub County.

James Kiptai was charged that on June 28, 2022 at around 9pm at Kampi Samaki sub location in Bartum location, Baringo South Sub County, he defiled a minor and escaped for fear of being lynched by angry residents.

He was arrested on July 1 before being arraigned in court on Monday and charged with defilement contrary to section (8) as read with section (8)3 of the Sexual Offences Act.

Kiptai who appeared before Senior Resident Magistrate Caroline Rose Ateaya also faced an alternative charge of committing an indecent act with a child contrary to section 11(1) of the Sexual Offences Act No.3 of 2006.

The accused denied the charges when read to him claiming he did not commit the offence levelled against him.

“Ni uwongo, your honour,” Kiptai told the court as he pleaded not guilty.

He prayed the court to release him on bond, committing himself to attend court whenever needed, a request which the prosecution counsel did not object.

Ateaya ordered the accused to be released on a bond of Sh200, 000 with one surety in similar amount and also supplied with witness statements.

The magistrate directed the case to be mentioned on July 18 and hearing fixed for August 2, when three witnesses are to testify.
