Court Of Appeal Overturns High Court’s Block On Al Ghurair

Its victory for IEBC as the Court of Appeal overturns High Court ruling blocking Al Ghurair of Dubai from printing presidential ballot papers.

This means Al Ghurair of Dubai can go ahead and print presidential ballot papers.

The High Court ruling had allowed the company to go ahead and  print ballot papers for the Senator, Governor, Mp Women representative and MCA seats, but not presidential ballot apers

According to the Court Of Appeal,a contract cannot be split. An election is one entity and printing is inseparable.

Judges upheld the decision that newspaper cuttings is not sufficient evidence proving president Kenyatta met with Al Ghurair CEO.

The Court Of Appeal Judge asserted that a sixth of a contract can’t be held as invalid and the rest as valid.

The high court judges failed to consider time constraints in the procurement process.

Court of Appeal also  ruled that public participation is not mandatory in a direct tender.

With all these said, the Court of Appeal overturned High Court ruling blocking Al Ghurair of Dubai from printing presidential ballot papers.
