Court Rules Dusit D2 Terror Suspects Have Case to Answer

In the ongoing Dusit D2 hotel terror attack case, the High Court has ruled that two men, Hussein Mohammed Abdile and Mohamed Abdi Ali, have a case to answer.

The ruling, delivered virtually by Lady Justice Hon. Diana Kavedza on January 21, 2025, came after thorough deliberation on the evidence presented by the prosecution.

The attack, which occurred on January 15, 2019, tragically claimed the lives of 21 people and left several others injured.

Following comprehensive investigations, Abdile and Ali were arrested alongside Mire Abdullahi.

Abdullahi later entered a plea bargain and was convicted.

“A ruling delivered virtually by Lady Justice Hon. Diana Kavedza on 21st January 2025, acknowledged that the two suspects namely Hussein Mohammed Abdile and Mohamed Abdi Ali were arrested alongside Mire Abdullahi following investigations into the terror incident that claimed the lives of 21 people, and injured several others,” stated the ODPP.

In her ruling, Hon. Kavedza stated, “having considered the evidence of 55 witnesses, including expert testimonies, and the material presented before me, I am satisfied that the prosecution has established a prima facie case against the two accused persons. I hereby place the second accused, Hussein Mohamed Abdile, and the third accused, Mohamed Abdi Ali, on their defence.”

The prosecution, led by Mr. Duncan Ondimu, OGW, expressed satisfaction with the court’s decision, underscoring the importance of accountability and justice for the victims of the heinous act.

The court has scheduled the hearing for February 5 and 6, 2025, at the Kahawa Law Court, where the defense will have the opportunity to present their case, including calling witnesses.
