Ex-Governor Waititu to Remain in Jail as High Court Denies Bail Pending Appeal

Former Kiambu Governor Ferdinand Waititu popularly known as Babayao will continue serving his 12-year jail term at the Industrial Area Prison after the High Court denied him bail.

This decision comes after the Office of the Director of Public Prosecutions successfully opposed his request for bail, pending an appeal related to a corruption case that the politician has submitted to the High Court.

“The DPP had urged the court to reject Waititu’s request for bail pending appeal, insisting he was lawfully convicted for corruption-related charges upon which he was sentenced to pay a fine of Ksh. 53 million or serve the 12 years imprisonment,” the ODPP said on X.

The ODPP reported that Mr. Waititu had filed an application at the High Court seeking bail pending the determination of his appeal against the conviction and sentence.

The former Governor of Kiambu commenced his prison sentence three weeks ago following a ruling by the Magistrates’ Court, which convicted him of offenses related to Conflict of Interest and Dealing with Suspect Property.

Lady Justice Lucy Njuguna has scheduled the case for mention on March 18, 2025, to provide further guidance regarding the substantive appeals.

The prosecution was led by Victor Juma Owiti, Principal Prosecution Counsel.
