A 26-year-old man has been sentenced to 20 years imprisonment for defiling and impregnating a 14-year-old standard eight girl.
According to the Office of the Director of Public Prosecutions (ODPP), the accused, Felix Otieno Okong’o, committed the crime multiple times between November 2020 and April 2021 at the Kabuoch location, in Ndhiwa sub-county, Homabay County.
During the hearing of the matter, the accused chose to testify under oath and presented two witnesses in court.
“During the hearing of the matter, the accused was placed on his defence and opted for a sworn testimony and presented 2 witnesses in court,” read the ODPP’s statement in part.
The Prosecution, led by Moses Okerosi, presented six witnesses, including the victim, whose testimonies corroborated the statements and proved the accused guilty.
The court presided over by Resident Magistrate Hon. B.W Murangasia, considered both the evidence presented by the prosecution and the mitigation by the accused person.
The Resident Magistrate also considered the impact of the accused’s actions on the life and education prospects of the minor and found him guilty.
Felix was convicted under section 215 of the Criminal Procedure Code.
The magistrate also noted that the offence had a significant physical, social and emotional impact on the young girl and the accused person showed no remorse for his actions.
“The magistrate noted that the offence strongly affected the young girl both physically, socially and emotionally and that the accused person showed no remorse for his actions,” stated the ODPP.
