High Court asked to suspend planned publication of 1,400 county laws

The High Court has been asked to suspend the planned publication of 1,400 laws passed by county assemblies over the last four years. The laws had been aligned to an order by the court which had poked holes into the legality of some of those put in the Kenya Gazette. The laws were approved for publication during a meeting of key stakeholders at the beginning of May.

Those who attended the meeting included governors, Government Press officers, County Assemblies Forum representatives, Intergovernmental Relations Technical Committee, Society of Clerks at the Table and the Office of Controller of Budget.

But on Monday, 10 voters led by James Gacheru said the Council of Governors wants to sidestep the national government and publish the gazette in breach of law. They said the council does not have powers to make such a publication as this is the government’s mandate. The court was told the publication will lead to filing of the same number of cases to challenge legality of the laws in question.
