The High Court has ruled that Machakos Wiper gubernatorial aspirant, Wavinya Ndeti, will be on the ballot papers on August 8 during the general elections.
Wavinya was facing thrisk of missing out in the ballot papers following a suit filed against her for not adhering to the electoral act.
Ndeti celebrated on Wednesday after Judge George Odunga ruled she is an eligible Wiper party candidate.
Giving the ruling, Odunga noted that the Political Parties Disputes Tribunal decided she is a bonafide member of of the party led by NASA principal Kalonzo Musyoka.
He said the IEBC committee had no power to nullify the tribunal’s decision.
The committee had defended its decision to bar Wavinya Ndeti from vying arguing that she employed political mischief, which was hatched by the Wiper Party to circumvent party resignation laws, as she did not qualify to contest under the party.
Wavinya insisted that she had followed the law, and ensured she was in Wiper Party’s list before the deadline set by IEBC, which is the main point of argument at the High Court.
