The Speaker of the National Assembly Moses Wetangula has approved the motion to impeach Agriculture Cabinet Secretary Mithika Linturi.
The motion was filed by Bumula Member of Parliament Jack Wamboka who was backed by 110 legislators.
Wamboka cited Gross violations of the provisions of the Constitution or any other law, Gross misconduct, and breach of public trust as grounds for impeachment.
According to Wetangula, the proposed motion by Bumula MP meets the requirement of Article 152 of the constitution and the standing order threshold that allows the Member of Parliament to file a notice.
“A member of the National Assembly, supported by at least one-quarter of all the members of the Assembly, may propose a motion requiring the President to dismiss a Cabinet Secretary,” reads the constitution.
The Parliament is expected to move the motion within seven days failure to which it will have collapsed.
The motion is scheduled for debate on Thursday, 2nd May whereby the house is expected to select a committee of 11 members to investigate the allegations brought forth against the CS.
The committee shall be formed with an affirmative vote of 117 Mps. Should the committee’s report find merit in the allegations, the CS will be accorded an opportunity to defend himself, before a vote on whether to approve a resolution requiring the dismissal of the cabinet secretary is tabled.
If the Select Committee report finds that the allegations are unsubstantiated, no further proceedings are taken thereafter.
