Kithimani Law Courts yesterday on 11th September 2024 sentenced a 41-year-old man to 29 years imprisonment for defiling his 12-year-old daughter.
According to the Office of the Director of Public Prosecutions(ODPP) the offence was committed on May 15, 2019, when the father was alone at home with the victim while the other siblings had left for school.
Following the incident, it is reported that the father physically assaulted the victim and issued threats to prevent her from informing her mother about the occurrence.
In his defense, the defendant asserted that he was set up due to a conflict with the mother of the victim regarding marital issues.
“After the incident, the father is said to have beaten the victim and threatened her not to report the incident to her mother. In his defense, the accused claimed that he was set up because of a marital dispute with the victim’s mother,” stated the ODPP.
The presiding magistrate, Hon. Wechuli, ultimately dismissed the allegations, determining that the prosecution, represented by Fredrick Kimathi, had established beyond a reasonable doubt that the defendant had committed the act of defiling the minor.
“Hon. Wechuli, the presiding magistrate dismissed the claims, ruling that the prosecution led by Fredrick Kimathi had proven beyond reasonable doubt that the accused had defiled the minor,” ODPP noted.
The magistrate agreed with the prosecution’s argument that the father, who was meant to protect his daughter, had instead turned into the predator.
