Former Minister Amos Kimunya and Co-Accused Ordered to Appear in Court Over Land Fraud Case

The Milimani Anti-Corruption Court has directed former Minister for Lands and Housing, Amos Kimunya, alongside Lilian Wangiri Njenga, former Director of Land Adjudication and Settlement, and Junghae Wainaina, Director of Midlands Limited, to appear in court on Monday, 24th February 2025.

The trio is set to receive further directions in a case involving the irregular allocation of public land to a private company.

This directive follows a request by the Director of Public Prosecutions (DPP) to the Judiciary, made through the Milimani Chief Magistrate Anti-Corruption Court, seeking a mention date for the matter to proceed.

A three-judge bench consisting of Justices P.O. Kiage, Ali-Aroni, and L. Achode had earlier ruled that the evidence presented by the DPP established a prima facie case against the accused.

Consequently, the judges dismissed their appeal and upheld the High Court’s previous ruling that had found sufficient grounds for prosecution. The case was then remitted to the Chief Magistrate’s Anti-Corruption and Economic Crimes Court for further proceedings.

“The accused face charges of Abuse of Office, Failure to Disclose a Private Interest to One’s Principal, Fraudulent Disposal of Public Property, and Breach of Trust by a Public Officer,” the ODPP said.

The case revolves around the allocation and transfer of a 25-acre parcel of land, designated as Nyandarua/Njabini/5852, from the Settlement Fund Trust (SFT) to Midlands Limited, a private entity.

Chief Magistrate Harrison Baraza will preside over the mention of the case on the scheduled date, where further directions on the hearing and trial process will be provided.
