Court Rejects Ferdinand Waititu’s Bid to Review 12-Year Sentence

The High Court has dismissed an application by former Kiambu Governor Ferdinand Waititu, who is serving a 12-year prison term, to have his sentence reviewed.

According to the Office of the Public Prosecutions (ODPP),in a ruling delivered on 16th September 2025, Lady Justice Lucy Njuguna rejected the plea filed on 28th August 2025, in which Waititu sought to overturn his conviction on corruption-related charges.

“Lady Justice Lucy Njuguna, in a ruling delivered on 16th September 2025, rejected an application filed on 28th August 2025, in which the former county boss sought to overturn his sentence on corruption-related charges,” noted the ODPP.

The former county boss was convicted in February 2025 and ordered to either pay a fine of Sh53.5 million or serve 12 years in jail.

The court found that he irregularly received Sh25 million from Testimony Enterprises after the award of a flawed tender, breaching principles of good governance and failing to safeguard public funds.

Justice Njuguna ruled that the sentence will stand pending the hearing and determination of Waititu’s appeal.

“She further directed that the appeal be concluded within 120 days, warning that any delays on the part of the former governor could lead to the case being struck out,” stated the ODPP.

In the meantime, Waititu will remain at Kamiti Maximum Prison, having failed to secure release after being unable to meet strict bond terms that required a Sh53 million bank guarantee.

The matter is scheduled for mention in court on 1st October 2025.
