AG makes submissions on death penalty case at Supreme Court

Kenya’s Attorney General Prof Githu Muigai was on Tuesday morning made his submission as amicus curiae (friend of the court) at the Supreme Court in a case seeking to establish the Constitutionality of the death penalty in the new constitutional dispensation.

Pertinent issues that are being raised in the Francis Kariakor Murwawatetu and Others Versus The Republic of Kenya Case at the Supreme Court include seeking to establish the Constitutionality of the death penalty, as well as the passing of the death sentence in criminal cases.

The case also comes up at a time when the United Nations General Assembly (UNGA) 3rd Committee recently deliberated on the global abolition of the death penalty.

The ruling on the judgment of the case by the full bench of the Supreme Court is widely anticipated as Kenya has not had any death sentence for the last 20 years since the cases have been commuted to life sentence.
