A court in Busia has sentenced a man to life imprisonment for committing incest with a 12-year-old child.
Stephen Owino Nekesa was charged under Section 20 (1) of the Sexual Offences Act No. 3 of 2006.
The court heard that the crime took place on August 28, 2023, in Khunyangu Village, located in Butula Sub-County within Busia County.
As an alternative charge, the accused was also charged with committing an indecent act with a child under Section 11 (1) of the Sexual Offences Act.
The prosecution, represented by Mr. Mumo, presented evidence and testimonies from four witnesses that detailed the incident.
“The evidence revealed that on the night of August 28, 2023, the complainant went to deliver food to her brother, the accused. Upon her arrival, he stepped outside, grabbed her, and forced her into the house,” stated the ODPP.
“He covered her mouth and pushed her into the bedroom, where he sexually assaulted her,” added the ODPP.
The trial court concluded that the prosecution had proven beyond a reasonable doubt that the accused committed incest as defined in Section 20 (1) of the Sexual Offences Act.
As a result, he was convicted and sentenced to life imprisonment.
