Elius Kemboi Korir, a businessman based in Nairobi, has been charged at the Milimani Law Courts for conspiracy to commit a felony in violation of Section 393 of the Penal Code, as well as for obtaining goods under false pretenses, contrary to Section 313 of the Penal Code.
On December 27, 2022, it is alleged that at the Simbi complex located along Falcon Road in Nairobi County, within the Republic of Kenya, the accused, in collaboration with others not currently before the court, engaged in a conspiracy to unlawfully acquire 300 bags of beans, each weighing 90 kg, with a total value of Ksh 4,590,000.
This property belonged to KOCH Limited, and the accused allegedly misrepresented that the beans were being supplied to Women and Youth against Aids and Poverty (WAYAAP), a public benefit organization that was purportedly responsible for the payment of these goods, despite knowing this information to be untrue.
On January 18, 2023, at a warehouse situated across from City Stadium in Nairobi County, it is alleged that he conspired with others to unlawfully acquire 300 bags of grade one (1) rice, each weighing 25kg, and 600 boxes of 800g Menengai cream bar soap.
According to the Office of the Director of Public Prosecutions the total value of these items is estimated at Ksh. 4,230,000, belonging to KOCH Limited.
“They purportedly misrepresented that these goods were being supplied to Women and Youth against Aids and Poverty (WAYAAP), a public benefit organization that was expected to finance the purchase of these items, a fact he also knew to false,” said the ODPP.
He pleaded not guilty to all the charges and was released on a Ksh 2 million bond with 2 sureties of similar amounts.
In the same court, Elius Kemboi Korir was charged with conspiracy to steal and obtaining 100 bags of 50 kg brown sugar, 575 jerricans of 20 litres of cooking oil, 770 jerricans of 20 liters of cooking oil, and 1600 bags of 25 kg of rice grade 1, all valued at Ksh 15,633,200 from Mallow Brand Limited by falsely pretending that he was in a position to pay a fact he knew was false.
He pleaded not guilty to all the charges and was released on a 2 million bond with a surety of a similar amount or an alternative cash bail of Ksh 1 million.
The ODPP further said that both cases will be mentioned on 7th January 2025.
