A Kwale court has sentenced a man to 20 years imprisonment for defiling a 13-year-old girl.
According to the Office of the Director of Public Prosecutions, Athuman Hamisi was convicted and sentenced to serve 20 years of imprisonment after prosecution through Collins Orwa produced six witnesses in court who testified against the accused.
The ODPP further said that he committed the offence on the 28th of December 2022 in the Kombani area in Kwale County.
Kwale Resident Magistrate Ruth Ogolla ruled that the prosecution had proved its case beyond any reasonable doubt and sentenced the accused person accordingly.
A Malindi court has also sentenced a man to life imprisonment for incest.
The ODPP said that Barack Kitsao was found guilty of committing incest with his four siblings aged between 12 years and 3 years. The sentence came after he was convicted of four counts.
Principal Magistrate Joy Shiundu ruled that the prosecution proved its case on the charges of incest contrary to section 20(1) of the Sexual Offences Act. No. 3 of 2006 against the accused person to the required standard of proof beyond any reasonable doubt and sentenced him to serve life imprisonment for each of four counts.
“I find that the prosecution established the victims were related to the accused person and the accused person knows that he was an elder brother to the victims,” ruled Shiundu.
“The accused person committed incest with his four young siblings including his 3 sisters and 2 brothers on diverse dates between 8th May 2023 and 30th June 2023,” said the ODPP.
The Office of the Director of Public Prosecutions reported that the offences were committed in Malindi Sub County, within Kilifi County.
The case was prosecuted by Benjamin Wambua.
