The Office of the Director of Public Prosecutions (ODPP) has reaffirmed its commitment to protecting vulnerable members of society after successfully securing a life sentence for a man convicted of incest and child abuse.
At the Kibera Law Courts, a 36-year-old man was handed life imprisonment for defiling his 13-year-old daughter.
Additionally he will serve five years after being found guilty of the charges.
“At the Kibera Law Courts, the the 36-year old was today handed life imprisonment for defiling his 13-year-old daughter,” stated the ODPP.
“The convict will serve an extra five years after being found guilty of subjecting the minor to cruelty by repeatedly assaulting her with a knife and using pegs to pinch her ears,” added the ODPP.
The case, prosecuted by Ms. Keitany, was supported by strong evidence that left no room for doubt.
Principal Magistrate Hon. Abdul, in delivering judgment, praised the prosecution’s thoroughness and noted the case had been proven beyond reasonable doubt.
According to the report, the minor, after being rescued and placed in a children’s home, confided in a social worker about the abuse.
“The court heard how the minor, after being rescued and placed in a children’s home, confided to a social worker that her father had been defiling her. Medical evidence and witness testimony corroborated her account, leading to the conviction,” noted the ODPP.
In her ruling, the Magistrate described the offence as “a complete lack of humanity”, stressing that defiling one’s own daughter amounted to the ultimate betrayal of parental duty.
However, the five-year cruelty sentence will remain in abeyance while the convict serves his life term.
