DPP Seeks Mental Assessment for Sarah Wairimu Before Plea in Tob Cohen Murder Case

The Director of Public Prosecutions (DPP) has requested the Kibera High Court to facilitate a mental assessment for Sarah Wairimu Kamotho before she takes a plea on a fresh murder charge.

The application was made by Prosecution Counsel Vincent Monda, Wangeci Gichui, Ebby Maswai, Christine Timoi, and Peris Maina during Ms. Wairimu’s court appearance.

“The application by the DPP was made through Prosecution Counsel Vincent Monda, Wangeci Gichui, Ebby Maswai, Christine Timoi and Peris Maina when Ms. Wairimu, who was arrested on the 23rd of January 2025 in Nairobi, was presented at the Kibera High Court this morning,” stated the ODPP.

Ms. Wairimu, who was arrested on January 23, 2025, in Nairobi, is accused of the 2019 murder of her husband, Dutch billionaire Tob Cohen.

The prosecution emphasized that a mental assessment is necessary to determine her fitness to stand trial for the charges brought against her.

Hon. Lady Justice Diana Kavedza directed that Ms. Wairimu be remanded at Lang’ata Women’s Prison pending her ruling on the application, scheduled for January 29, 2025.

The DPP’s decision to charge Ms. Wairimu afresh follows a comprehensive review of the case file, which revealed sufficient evidence to proceed with the murder charge under Section 203 as read with Section 204 of the Penal Code.

Tob Cohen, a prominent Dutch businessman, was reported missing in July 2019 before his body was discovered in a septic tank at his Kitisuru residence in Nairobi two months later.

The court’s ruling on the mental assessment will determine the next steps in the high-profile trial.
