Former Machakos CEC Ordered to Deposit KES 80 Million as Security for Judgment Pending Appeal

Former Machakos County Executive Committee (CEC) Member Urbanus Wambua Musyoka has been directed to deposit KES 80,251,815 as security for judgment pending appeal, following a ruling by the Anti-Corruption Court on February 28, 2025.

The Ethics and Anti-Corruption Commission (EACC) successfully obtained forfeiture orders in October 2024, requiring Mr. Musyoka to surrender KES 91,202,892 in unexplained assets.

However, the former county official challenged the ruling by filing a notice of appeal on October 29, 2024, alongside an application to stay the execution of the judgment while the appeal is heard.

In his ruling, Justice Musyoka granted the application for a stay on the strict condition that Mr. Musyoka deposits the sum in an interest-earning account jointly operated with the EACC within ninety days.

“There shall be stay of execution of the judgement and decree of this court dated 28-10-2024 on condition that the defendants shall deposit Kshs. 80,252,815.00 in an interest earning account with a reputable bank in Kenya to be operated jointly by the advocates for the plaintiff and the advocates for the defendants within the next ninety (90) days from the date of this ruling,” read the ruling.

The court further emphasized that failure to comply with the order would lead to the automatic lapse of the stay, granting the EACC the green light to execute the judgment.

Mr. Musyoka now faces a critical deadline to comply with the court’s directive or risk immediate enforcement of the original forfeiture order.
