Machakos high court has ordered that a prisoner alleging to have been tortured by a prison warden to record a statement on the same at the Machakos Police station for investigations to be conducted.
This is after the complainant was presented in court where he says he has been suffering and was beaten by an officer well known to him but on reporting to the prisons authority no action was taken to the alleged officer.
Judge Kimei read in a statement that at one time on 17th february this year Prisoner Dominic Nzangi was taken to Machakos hospital where he received treatment and administered drugs and a physiotherapy done to him.
According to the statement it was recorded that the prisoner was found with unwanted illegal stuff in a search that was conducted in the prison .
According to the prison department the illegal stuff isn’t allowed inside the Prison according to the rules and punishment was administered to him together with other prisoners among the punishment was 7 days of remission being removed from his term
Daniel Mwongera the State counsel said that Dominic Nzangi had brought his prayers before the honourable court so as to be allowed to take his appeal to court which was allowed and after the on going appeal thats when he raised the concern of being tortured.
Nzangi said that he was beaten and hurt by a Prison warden and that’s why he was appealing to the court to be heard.
Justice David Kimei ordered that prisoner Nzangi be escorted to Machakos level 5 hospital for treatment and assessment as well as review of the previous treatment which was disbursed by the said hospital on the 17th February 2021 .
Kimei also ordered that mention dates be given for further directions to know whether the issues will have been taken care of after which the file will be forwaded to the court of appeal.
The mention date will be on 22nd June 2021
