The Independent Policing Oversight Authority (IPOA) has launched into investigations over the withdrawal of security for a High Court judge and the disobedience of court summons by certain individuals within the security services.
According to IPOA, the withdrawal of security for the judge violates established protocols that safeguard judicial officers.
This act raises serious concerns about the independence and safety of the judiciary, which is a cornerstone of the rule of law in Kenya.
“In view of the foregoing, the Independent Policing Oversight Authority, on its own motion, has instituted investigations into the alleged withdrawal pursuant to section 6 of the Independent Policing Oversight Authority Act, Cap 86 Laws of Kenya,” read the statement.
“The investigations will inform recommendations, including but not limited to prosecution, where culpability is established,” IPOA added.
Additionally, IPOA has expressed concern over the failure of certain security personnel to honor court summons.
The authority underscored that disobeying court orders undermines the justice system and sets a dangerous precedent for public accountability.
“The authority also notes that in the cited matter presided over by Justice.Hon.Mugambi the High Court issued several summons to the Ag.IG which were not honoured.This culminated in the AG. IG being found in contempt of court and was subsequently sentenced.Failure to honour summons is unlawful and violates article 244 of the constitution.It sets a dangerous precedent which encourages impunity and disregard for the rule of lawa,” the statement read in part.
The Independent Policing Oversight Authority reiterated its commitment to ensuring accountability within the security services and protecting the rights and freedom of all Kenyans.
