Kamenu Ward MCA and Another Arraigned on Charges of Conspiracy, False Information

Kamenu Ward MCA Peter Mburu Mungai and Patrick Ng’anga Mungai were arraigned at Milimani law courts to face four charges against them relating to conspiracy to commit a felony contrary to Section 293 of the Penal Code.

The duo faced charges of conspiring to commit a felony as per Section 293 of the Penal Code. It was alleged that between May 10th and 17th, 2024, at an undisclosed location within Kenya, along with others not yet arraigned, they conspired to disseminate false information.

“The two were charged with conspiracy to commit a felony contrary to Section 293 of the Penal Code, where allegedly between the 10th and 17th May 2024 at an unknown place within the Republic of Kenya,” stated the ODPP.

Specifically, they falsely claimed that land parcel number Thika Municipality Block 30/1825 in Kiganjo, within Kamenu Ward, was owned by the county government, despite knowing or should have known that it actually belonged to Kiganjo Location Ranching CO.LTD and had been allocated to the National Government for the construction of Kiganjo Kimuchu Modern Market.

Additionally, Patrick Nga’nga Mungai was charged with the publication of false information, contrary to Section 22(2)(1) of the Computer Misuse and Cybercrime Act No. 5 of 2018.

It is alleged that on diverse days at an undisclosed location within the Republic of Kenya, he published false information using his mobile number via a WhatsApp group, NGOLIBA WARD LATEST, knowingly or ought to have known that such publication was false and likely to provoke and incite violence.

The two denied all the four charges against them and were released on a Ksh.600, 000 bond and surety of the same amount or an alternative cash bail of Ksh200,000 with two contact persons.

The case is slated for pre-trial on 19th June 2024.
