Kitui MCA Charged with Fraud over Motor Vehicle Registration and False Claims

A Member of the County Assembly from Kitui has been accused of acquiring motor vehicle registration through deceptive means, in violation of Section 320 of the Penal Code.

Cyrus Kisavi Musyoka, the MCA for Ikanga Ward, is alleged to have fraudulently registered motor vehicle number KCM 760Z by misrepresenting himself as the legitimate owner.

The Office of the Director of Public Prosecutions has indicated that he faces additional charges, including two counts of conspiracy to commit a felony, two counts of forgery, two counts of presenting false documents, and making a false claim while serving in a public capacity.

“The court heard that on the 12th of January 2023, at an unknown time at the County Assembly of Kitui in Kitui Township of Kitui County within the Republic of Kenya, as a member of the County Assembly of Kitui in a capacity that allowed him to claim for a motor vehicle reimbursement, he made a claim for a sum of Ksh. 2,212,000 to be payable to himself, which he knew was false,” the ODPP said on an X post.

The ODPP reported that Hon. Cyrus Musyoka pleaded not guilty to charges before Kitui Principal Magistrate Hon. Sindani and was released on a bond of Ksh.500, 000

The case was prosecuted by Assistant Director of Public Prosecution Mr. Paul William Ochieng.

The matter will be mentioned on 6th March for pretrial and further directions.
