The office of the Director of Public Prosecutions (DPP) has expressed dissatisfaction with the decision to acquit Members of Parliaments Ferdinand Waititu and Moses Kuria incitement charges citing lack of evidence.
Through a memo signed by Duncan Ondimu, Principal Prosecution Counsel at Milimani Chief Magistrate Court, the prosecutor said that the video is enough evidence to charge the two.
“On the 20th day of February 2017, the trial Court delivered Ruling in which the Court acquitted the Accused under Section 210 of the criminal Procedure Code,” read the memo in part.
“The Prosecution is aggravated and dissatisfied with the Ruling issued by the Trial Court and intends to Appeal the said orders at High Court,” the statement continued.
The prosecution requested the Trial Court to “provide (urgently)” them with “certified copies of the Proceedings and Ruling” to the Prosecution pursue the remedies provided under the law.
