The Office of The Director Of Public Prosecutions has upheld the verdict issued by Milimani High Court judge, Lady Justice Grace Nzioka. She sentenced Joseph Kuria Irungu alias Jowie, to death for the murder of businesswoman Monica Nyawira Kimani on the night of 19th September 2018.
The ODPP noted that the prosecution while convincing the court for a stiffer penalty outlined the aggravating factors that include the discovery of the deceased’s lifeless body in the bathtub, the determination of death by a neck injury, the use of a dangerous weapon, premeditation of the offence, absence of provocation from the deceased, attempted concealment of evidence, and the harm inflicted upon the deceased.
While delivering her judgement, Lady Justice Grace Nzioka stated that the court had considered 3 things while giving the sentence; the circumstance of the case, the evidence presented and the nature of the offence. She further emphasized the gravity of the crime, describing it as a heinous act and a loss to society.
Lady Justice Nzioka emphasized the intentional and planned nature of the murder. She noted the tragic loss of life and the profound impact on Kimani’s family, particularly her mother, who suffered depression and a stroke following her only daughter’s death.
The probation officer Andrew Kangotu in his report described Jowie 33, as one who lacks stable partner relationships, has anti-social behaviours, is impulsive and has a double personality trait.
The prosecution led by Ms Catherine Mwaniki, Ms Wangui Gichuhi and Ms Brenda Parklea expressed satisfaction with the court’s decision.
