Senator Maanzo Rebuked Over Censure Motion: ‘Out of Order and Legally Baseless’

The Cabinet Secretary for the Ministry of Environment, Climate Change and Forestry Hon. Aden Duale rebuked Senator Dan Maanzo over the censure motion against the President of the Republic of Kenya Dr. William Ruto.

Taking to his social media page the CS said that the censure motion has no constitutional basis in a parliamentary parlance and that such a motion has no legal effect.

“At the risk of repeating the obvious Sen. Maanzo, a censure motion has no constitutional or procedural basis in parliamentary parlance. It has no legal effect, it has no consequences and anyone wishing to remove a State Officer from office must follow the laid down, clearly prescribed and express constitutional provisions,” CS Aden Duale said on X.

“I also repeat, a substantive motion to discuss the conduct of a State Officer is simply a rule of debate and cannot be clothed as a censure motion,” he added.

“You are therefore certainly out of order! Your censure motion, if indeed true, baffles many as to how one can move in nullity, is an unfounded, frivolous and pure political sideshow. This is free and unsolicited advice to you and for practical advice, you may compare notes with the great Senator for Tana River who I also gave free advice last week. He knows better now,” the CS added.

The Makueni Senator Hon. Dan Maanzo filed a censure motion against President William Ruto and it was received by the Clerk of the Senate on Tuesday 1st October 2024.

Among the reasons for the censure motion, Senator Maanzo said that concerned that HE. Dr. William Ruto, President of the Republic of Kenya and CIC is the head of state and government under Article 131 and the chairperson of the National Security Council has failed to protect Kenyans against Police Brutality and killings.

According to the Senator, the President has also reduced the allocation to counties and delayed financing to devolved units causing untold suffering to Kenyans who are sick by failing to devolve Health and Agriculture fully as required by Schedule (4) four of the constitution.
