Validity of Gubernatorial election case kicks off

The case challenging the validity of the Narok County Governor election will kick off on Monday after the team of advocates representing all the parties agreed to finalize their submissions within four days.

The case was filed by former Narok North Member of Parliament (MP) Moitalel Ole Kenta, who lost in the gubernatorial race to the current Narok governor Patrick Ntutu.

Kenta who was represented by Professor Tom Ojiende and Paul Nyamodi has named the Independent Electoral and Boundaries Commission (IEBC) as first respondents while Governor Ntutu was named as the second respondent.

Narok Deputy Governor Tamalinye Koech and Narok County Elections Manager Dr. Sidney Namulungu were named as the third and fourth respondents respectively.

Lady Justice Teresia Matheka directed the parties to finalize their submissions so that the hearing could start immediately.

The parties agreed that the first respondent would present a certificate of certified copies of printout of all voter logs within four days.

The court allowed the first respondent to access presidential ballot boxes with a view to access the manual register and if the manual register was not found in the presidential box, then they are at liberty to access the other five ballot papers.

Justice Matheka cautioned the parties against bringing any excuse on Monday as she will not allow further extension of the case.

The IEBC is represented by lawyers Mr Erick Mutua and Allan Meing’ati while governor Ntutu is represented by senior Council Prof Kioko Kilukumi.

Mr Ntutu garnered 158,100 votes against Mr Kenta’s 148,270 votes according to the results announced by County Returning Officer Dr Sidney Namulungu after the August 9 polls.
