A defilement case against a Kisii County MCA took a twist after the alleged victim filed an affidavit at Ogembo Law Courts, taking the prosecution by surprise when its hearing kicked-off.
In her sworn statement the victim requested the court to withdraw the charges against Evans Omwansu Mokoro saying she was not the complainant and was not raped leading into pregnancy and delivery of a child. Senior principal magistrate Denis Mukoyan directed that the child be brought before the court on May 20, 2019, when the case hearing will resume.
She further stated that she requested the court to order the DCIO Nyamarambe to hand over her child aged over 1 year. The victim also said she will refuse non-authorization of extraction of DNA test samples from her and her child as contemplated by the prosecution citing intrusion of privacy.
According to the victim, the parentage of the child was a matter only confidential to her. Mokoro representing Moticho Ward in Gucha South had pleaded not guilty to the charge which stated that between June and September 2016 he defiled a minor at Nyambarambe in Gucha South Kisii County.
